1.1. This Privacy Statement and Personal Information Collection Statement explains how Hong Kong Computer Society (“HKCS”, the “Society”, “we”, “us” or “our”) collects, holds, processes, uses, discloses and transfers personal data relating to our members, membership applicants, event participants, website users, subscribers, volunteers, business contacts, service users and other individuals who interact with us.
1.1. 本私隱聲明及個人資料收集聲明說明香港電腦學會（「本會」或「我們」）如何收集、持有、處理、使用、披露及轉移與本會會員會員申請人、活動參加者、網站使用者、訂閱者、義工、業務聯絡人、服務使用者及其他與本會互動人士有關的個人資料。
1.2. This Statement applies to personal data collected through paper forms, online forms, membership applications, event registrations, payment processes, surveys, email communications, telephone enquiries, websites, online platforms, mobile or electronic channels, and in-person interactions. Where a separate or additional collection notice is provided for a specific programme, event, platform or activity, that notice should be read together with this Statement.

3.1. HKCS respects personal data privacy and is committed to complying with the data protection principles and all applicable requirements under the Personal Data (Privacy) Ordinance. We will collect personal data by lawful and fair means, use personal data for lawful purposes directly related to our functions and activities, and take reasonably practicable steps to protect personal data from unauthorised or accidental access, processing, erasure, loss or use.
3.1. 本會尊重個人資料私隱，並承諾遵守《個人資料（私隱）條例》下的保障資料原則及所有適用規定。本會將以合法及公平方式收集個人資料，為與本會職能及活動直接相關的合法目的使用個人資料，並採取合理切實可行步驟保障個人資料免受未經授權或意外查閱、處理、刪除、遺失或使用。
4. Personal Information Collection Statement

4.1. On or before collecting personal data from you, HKCS will take reasonably practicable steps to inform you of the purposes of collection, whether the provision of data is obligatory or voluntary, the consequences of failing to provide obligatory data, the classes of persons to whom the data may be transferred, and your rights of access and correction. This Statement is intended to serve as HKCS’s general Personal Information Collection Statement. It may be supplemented by additional notices at particular collection points.

5. Categories of personal data collected

5.1. Depending on your relationship with HKCS, we may collect the following categories of personal data: name, title, salutation, contact details, correspondence address, email address, telephone number, membership number, username, login details, employer or organisation, job title, business contact details, professional qualifications, education background, membership status, application details, event registration details, attendance records, payment and receipt records, donation or contribution records, communication preferences, survey responses, enquiry records, complaint records, photographs, audio or video recordings taken at events, and any other information that you voluntarily provide to us.

5.2. Where identity document numbers, copies of identity documents, payment card or bank information, dietary requirements, accessibility needs, health-related information or other information requiring particular care is collected, HKCS will only collect such information where it is necessary for a lawful purpose directly related to our functions or activities, and will apply appropriate access, retention and security controls.

6. Mandatory and voluntary provision of data

6.1. Personal data marked as mandatory, required or necessary on HKCS forms, websites, platforms or communications must be provided if you wish HKCS to process the relevant application, registration, request, transaction or service. If you do not provide such mandatory data, HKCS may be unable to process your membership application, maintain your membership, register you for an event, issue receipts, process payments, provide services, respond to your enquiry, handle your request, or comply with applicable requirements. Other personal data is provided voluntarily.

7. Purposes of collection and use

7.1. HKCS may collect and use your personal data for membership-related purposes, including processing membership applications, renewals, upgrades, changes, suspensions and terminations; verifying eligibility; maintaining membership records; providing membership benefits; communicating with members; issuing notices; and administering member services, committees, working groups, elections, awards and professional recognition activities.

7.2. HKCS may collect and use your personal data for event, education and operational purposes, including organising, administering and following up on seminars, conferences, forums, training programmes, examinations, competitions, awards, networking events, visits, professional development activities and other HKCS programmes; processing registrations and attendance; issuing certificates or confirmations; managing venues, speakers, trainers, judges, volunteers and participants; and providing event-related communications.
7.2. 本會可為活動、教育及營運目的收集及使用您的個人資料，包括籌辦、管理及跟進研討會、會議、論壇、培訓課程、考試、比賽、獎項、交流活動、參觀、專業發展活動及其他本會項目；處理報名及出席紀錄；發出證書或確認文件；管理場地、講者、導師、評審、義工及參加者；以及提供活動相關通訊。
7.3. HKCS may also collect and use your personal data for administrative, accounting, communication, compliance and legal purposes, including issuing receipts, processing payments, maintaining accounting and audit records, conducting member surveys and research, preparing statistics and service improvements, handling enquiries and complaints, managing disputes and claims, complying with laws, regulations, codes, court orders or lawful requests, protecting HKCS’s rights and interests, and any purpose directly related to the above purposes.

8. Direct marketing and promotional communications

8.1. Subject to applicable legal requirements, HKCS may use your name, contact details, email address, telephone number, correspondence address, membership status, event interests and communication preferences for direct marketing of HKCS membership, events, seminars, conferences, training programmes, professional development activities, publications, awards, surveys, initiatives and related services.

8.2. HKCS will not use your personal data for direct marketing unless we have provided you with the information required by the Personal Data (Privacy) Ordinance and obtained your consent or indication of no objection where required. You may indicate your preference by ticking the relevant box, completing the relevant consent field, clicking the relevant online option, responding to our communication, or otherwise informing us through the response channel provided. Where consent is obtained orally and written confirmation is required by law, HKCS will provide such confirmation in accordance with the applicable requirements.

8.3. You may opt out of direct marketing at any time without charge by using the unsubscribe link in our electronic messages, changing your communication preferences where such function is available, or contacting HKCS at hkcs@hkcs.org.hk. After receiving your opt-out request, HKCS will stop using your personal data for direct marketing as soon as reasonably practicable.

8.4. HKCS will not provide your personal data to third parties for their direct marketing unless HKCS has first provided you with the information required by law and obtained your consent in accordance with applicable legal requirements. For the avoidance of doubt, HKCS may promote events, programmes or initiatives that involve co-organisers, sponsors, speakers, trainers or partners, but HKCS will not transfer your personal data to such third parties for their own direct marketing without the required consent.

8.5. Where promotional communications are sent by electronic means, HKCS will take reasonably practicable steps to comply with applicable requirements relating to sender identity, unsubscribe facilities and cessation of messages, including requirements under the Unsolicited Electronic Messages Ordinance (Cap. 593) where applicable.

9. Disclosure and transfer of personal data

9.1. HKCS may disclose or transfer personal data to the following classes of persons where necessary for the purposes stated in this Statement or any directly related purpose: HKCS officers, council members, committee members, employees, authorised representatives and volunteers; service providers and data processors; IT, cloud hosting, email distribution, payment processing, accounting, printing, mailing, event management, survey, analytics and professional service providers; event co-organisers, venues, trainers, speakers, judges, sponsors or partners; banks, payment processors, insurers, auditors, legal advisers and other professional advisers; government departments, regulators, law enforcement agencies, courts, tribunals or other competent authorities; and any other person to whom you have consented.

9.2. Where HKCS engages service providers or data processors to process personal data on our behalf, HKCS will take reasonably practicable steps to require them to protect personal data, use it only for authorised purposes, keep it confidential, implement appropriate security measures, and not disclose it to unauthorised persons.

10. Cross-border transfer and cloud storage

10.1. Some of HKCS’s service providers, IT systems, cloud storage, email distribution platforms, event platforms, payment processors or analytics tools may process, store or access personal data outside Hong Kong. Where personal data is transferred outside Hong Kong, HKCS will take reasonably practicable steps to protect the personal data, including using contractual, technical and organisational safeguards where appropriate.

11. Retention of personal data

11.1. HKCS will retain personal data only for as long as necessary to fulfil the purposes for which it was collected or used, or as required or permitted by applicable law. HKCS will take reasonably practicable steps to erase, destroy or anonymise personal data when it is no longer required for the relevant purpose, unless retention is necessary for legal, accounting, audit, dispute resolution, compliance, security, archival or legitimate operational purposes.

11.2. Unless a longer retention period is required or justified for the purposes stated above, HKCS’s indicative retention approach is as follows: unsuccessful membership application records will be destroyed or anonymised within 6 months after completion of the relevant application process; member records will generally be retained during membership and for 7 years after membership ceases; event registration and attendance records will generally be retained for 7 years after the relevant event; payment and accounting records will be retained for the period required for accounting, audit and legal purposes; direct marketing records will be retained until you opt out or until they are no longer required; and website logs and analytics records will generally be retained for 12 months unless a longer period is required for security, investigation or technical purposes.

12. Accuracy of personal data

12.1. HKCS will take reasonably practicable steps to ensure that personal data held by it is accurate having regard to the purpose for which the data is used. You should inform HKCS as soon as reasonably practicable if your personal data changes or if you believe that personal data held by HKCS is inaccurate or incomplete.

13. Security measures

13.1. HKCS will take reasonably practicable steps to protect personal data against unauthorised or accidental access, processing, erasure, loss or use. These measures may include access controls, password protection, encryption where appropriate, secure transmission, staff confidentiality obligations, restricted access on a need-to-know basis, backup procedures, vendor due diligence, contractual safeguards and incident response procedures.

13.2. No method of transmission over the internet or method of electronic storage is completely secure. HKCS will nevertheless apply security measures that are reasonably appropriate having regard to the nature of the personal data, the potential harm that could result from unauthorised or accidental access, processing, erasure, loss or use, and the practical circumstances of HKCS’s operations.

14. Event photographs, videos and recordings

14.1. HKCS may take photographs, audio recordings or video recordings at events, seminars, conferences, training programmes, awards, competitions or other activities. Where such materials identify an individual, they may constitute personal data. HKCS may use such materials for event records, reporting, publications, websites, social media, newsletters, publicity and promotional purposes, where lawful and appropriate notice has been given. If you have concerns about being photographed or recorded at an event, you should contact HKCS or the event organiser as soon as reasonably practicable.

15. Website logs and technical information

15.1. When you visit HKCS websites or online platforms, HKCS may automatically collect technical information, including IP address, browser type, device information, operating system, pages visited, date and time of visit, referring website and general usage patterns. Such information may be used for website administration, security, statistical analysis, service improvement, troubleshooting, fraud prevention and evaluation of online communications. Where such information identifies an individual directly or indirectly, HKCS will handle it as personal data.

HKCS may use cookies, web beacons, tags, scripts or similar technologies to support website functionality, remember preferences, analyse usage, improve our services and evaluate online communications. You may adjust your browser settings to refuse or delete cookies. However, some website functions may not operate properly if cookies are disabled.

17.1. HKCS websites or communications may contain links to third-party websites. This Statement does not apply to third-party websites, and HKCS does not control and is not responsible for their privacy practices, security, content or use of personal data. You should review the privacy policies of those third-party websites before providing any personal data to them.

18. Access to personal data

18.1. You have the right to request access to personal data held by HKCS about you in accordance with the Personal Data (Privacy) Ordinance. A data access request may include a request to be informed whether HKCS holds personal data of which you are the data subject and, if so, to be supplied with a copy of such data.
18.1. 您有權根據《個人資料（私隱）條例》要求查閱本會持有的關於您的個人資料。查閱資料要求可包括要求本會告知是否持有您作為資料當事人的個人資料，並在持有時向您提供該等資料的副本。
19. Correction of personal data

19.1. You have the right to request correction of personal data held by HKCS about you if the data is inaccurate. Where HKCS is satisfied that the relevant personal data is inaccurate, HKCS will make the necessary correction in accordance with the Personal Data (Privacy) Ordinance. Where required by law, if HKCS corrects personal data that has been disclosed to a third party, HKCS will take all practicable steps to supply the relevant third party with the corrected data and a notice stating the reasons for correction.

20. Withdrawal of direct marketing consent and communication preferences

20.1. You may withdraw consent to direct marketing or update your communication preferences at any time without charge. Withdrawal of consent will not affect HKCS’s use of your personal data for non-marketing purposes, including membership administration, event administration, legal compliance, payment records, service notices and other purposes stated in this Statement.

21. Requests, enquiries and verification

If you wish to make a data access request, data correction request, withdraw direct marketing consent, update your communication preferences, request deletion or cessation of retention where applicable, or make any privacy enquiry, please contact HKCS using the contact details in Clause 2. HKCS may ask you to provide information reasonably necessary to verify your identity and process your request. HKCS may charge a reasonable fee for complying with a data access request where permitted by law.

22. Deletion or cessation of retention

22.1. You may request HKCS to delete or cease retaining your personal data where applicable. HKCS will consider such requests having regard to the purposes for which the data was collected or used and any applicable legal, accounting, audit, contractual, dispute resolution, compliance, archival or operational requirements. HKCS may be unable to delete personal data immediately if continued retention is required or permitted by law or is reasonably necessary for a stated purpose.

23.1. If you have any concern or complaint about HKCS’s handling of your personal data, please contact HKCS using the contact details in Clause 2. HKCS will review and respond to your complaint as soon as reasonably practicable. If you are not satisfied with HKCS’s response, you may contact the Office of the Privacy Commissioner for Personal Data in Hong Kong.

24.1. HKCS may use, disclose or transfer personal data where required or permitted by law, regulation, code, court order, lawful request, legal process, regulatory requirement, law enforcement request, or where reasonably necessary for establishing, exercising or defending legal rights, preventing or detecting unlawful conduct, protecting the safety or security of individuals, or protecting HKCS’s lawful interests.

25.1. Where HKCS collects personal data from children or minors in connection with education, training, competitions, awards, youth programmes or events, HKCS may require consent or information from a parent or guardian where appropriate. HKCS will take reasonably practicable steps to ensure that the collection and use of such personal data is fair, lawful and proportionate to the relevant activity.
